Description

Der Friedensvertrag des bohmischen Konigs Georg von Podiebrad (1458-1471) sucht eine Alternative zur bestehenden mittelalterlichen Ordo (respublica christiana) und bietet damit einen Ausblick auf die kommende weltliche Ordnung Europas. Gleichzeitig deutet der Friedensvertrag die Geburt des Volkerrechts an. Er vereint in sich zwei Aspekte - den eines Bundnisses und den eines Bundes. Grundlage der Podiebradschen Friedensliga und somit der Ausgestaltung der inter-europaischen Beziehungen sollte die Figur einer durch Schwur begrundeten Korporation sein. Die Einzigartigkeit des Vertrages liegt aber nicht in der Schaffung von etwas vollig Neuem, sondern in der Zusammenfuhrung vorgefundener Rechtstraditionen und Ideen. Er stellt dabei einen herausragenden Beleg fur den Rechtspluralismus des Mittelalters dar. The peace treaty of the Bohemian King George of Podiebrady (1458-1471), looked for an alternative to the existing medieval order (respublica christiana) and thereby offered a view on the forthcoming world order in Europe. At the same time, the peace treaty indicates the birth of international law. It unifies in itself two aspects, an alliance and a federation. The basis for the Podiebrady Peace Treaty and thus the development of inter-European relations should be the symbol of corporation made reasonable by oath. The uniqueness of the treaty is not in the creation of something completely new, but in the consolidation of legal traditions and ideas. It shows an outstanding testimony for the legal pluralism of the middle ages.
