Authors in Germany were granted a claim against their publishers for an equitable remuneration by the German legislature in 2002. Ever since, courts have been struggling with the definition of what makes a remuneration "equitable". This thesis analyzes the entire existing case law and systemizes the most common criteria used by the courts. It further identifies the most pressing and current questions for courts in defining an equitable remuneration according to 32(2) of the German Copyright Act today.
