This book explores the legal impact of ESG (Environmental, Social, and Governance) clauses in supply contracts from the perspective of SME suppliers. While ESG clauses aim to promote responsible business practices, they can disproportionately burden small suppliers, particularly in sectors like the Belgian milk sector.
Through a case study of this sector (interviews) and legal analysis, this book shows that traditional contract law mechanisms are often insufficient to address these imbalances. It argues for a more relational and cooperative enforcement approach, emphasizing the buyer’s responsibility to support SMEs in complying with ESG requirements.
